Mr. Miller founded the law firm of Miller, Balis & O'Neil P.C. to represent municipal and cooperative gas and electric clients. In addition to representing municipal and cooperative gas and electric clients before the Federal Energy Regulatory Commission, various state commissions and the courts, Mr. Miller also serves as the General Counsel of the American Public Gas Association. In recent years, he also has served as an aribitrator.Following graduation from law school, Mr. Miller clerked for one year for Judge E. Barrett Prettyman of the United States Court of Appeals for the District of Columbia Circuit. He created his own law firm in 1978, and it became Miller, Balis & O'Neil, PC in 1980.A native of Charleston, West Virginia, Mr. Miller currently resides with his wife in Bethesda, Maryland.Regulation Mr. Miller has participated in virtually every type of regulatory proceeding imaginable, before both federal and state regulatory agencies, including rate-increase filings, certificate proceedings, merger applications, client-initiated complaint proceedings, and proceedings before a settlement judge. Mr. Miller has also participated in arbitration proceedings, and has represented parties in appellate proceedings emanating from the regulatory agencies' final orders. Perhaps most importantly Mr. Miller has participated in the often creative resolution of most of these regulatory proceedings through the settlement process, thereby in most instances avoiding protracted and expensive litigation.Energy Transactions Mr. Miller has participated, along with his clients, in the transition of the gas and electric industries to open access transportation and deregulation of supply. The effect of this has been increased focus on RFPs and responses thereto, extensive contract drafting and negotiation regarding both gas supply acquisition and power purchase agreements, and brainstorming with clients regarding their strategic responses to industry evolution. |
