Mr. Cramer has extensive experience in intellectual property and related commercial matters, primarily in the areas of computer hardware and software, data communications, and telephony. In addition to his career as a lawyer, he has more than 15 years experience in the software industry and has written numerous books and magazine articles on technology topics.
Mr. Cramer is a Registered Patent Attorney with the U.S. Patent and Trademark Office.
Experience
Mr. Cramer has represented plaintiffs and defendants in a wide variety of commercial disputes relating to technology. He has represented both patent holders and accused infringers in patent infringement lawsuits and appeals involving a variety of technologies and industries, including web browser technology, internet credit card transaction security, web-based educational tools, directory-enabled networking, oil well drilling fluid formulation and pipeline valve design. In addition, he has represented numerous defendants accused of copyright infringement of computer software and architectural designs. Further, he has represented plaintiffs and defendants in technology-related commercial lawsuits and appeals involving a variety of issues, including trade secrets, covenants not to compete, corporate governance, contract disputes, and employment discrimination.
Mr. Cramer has also represented businesses in a variety of intellectual property transactional matters, including registering trademarks with the U.S. Patent and Trademark Office, evaluating, maintaining and protecting clients' intellectual property portfolios, and drafting, reviewing, and enforcing software development and licensing contracts.
Significant Decisions
Represented one of several major corporations that allegedly infringed a patent related to network security. Reported at Reid, et al. v. GM, et al., 489 F. Supp. 2d 614 (E.D. Tex. 2007).
Represented an oil field services company against a competitor drilling services company that had allegedly infringed its patent relating to a novel drilling fluid.
Represented an oil field equipment manufacturer that allegedly infringed a patent relating to a pipeline valve mechanism.
Represented an inventor against over thirty major corporations that allegedly infringed his patent relating to web browsing technology. Reported at Netscape Communications Corp. v. Konrad, 295 F.3d 1315 (Fed. Cir. 2002).
Represented an educational services business that allegedly infringed a software development company's copyrighted material and using its trade secrets in filing a patent application.
Represented one of several financial services defendants that allegedly infringed a patent related to the processing of credit card transactions over the Internet.
Represented a hospital that allegedly infringed the copyrighted architectural plans of another hospital.
Represented a business that allegedly discriminated against and wrongfully terminated three former employees. Reported at Kwong v. AFR, 132 Fed. Appx. 18 (5th Cir. 2005).
Represented a business in enforcement of discovery sanctions against opposing counsel. Reported at Am. Flood Research, Inc. v. Jones, 192 S.W. 3d 581 (Tex. 2006).
Represented a business whose IT employees planted a variety of software "bombs" in an attempt to extort a half-million dollar payment from the business.
Represented a business in a dispute with a city over the user of her property. Reported at Baird v. City of Melissa, 170 S.W.3d 921 (Tex. App.-Dallas 2005).
