Mr Intrieri was appointed to the board effective December 27, 2006, to replace Mr. Weber as a member of the board to serve in such capacity for the remainder of Mr. Weber’s term of office and until the next annual meeting of the stockholders of the Company and/or his successor is duly elected and qualified, unless sooner removed in the manner provided in the Company’s bylaws. Mr. Intrieri is a director of American Property Investors, Inc., the general partner of AREP. Mr. Intrieri is a Senior Managing Director of Icahn Partners LP and Icahn Partners Master Fund LP, private investment funds controlled by Mr. Icahn. AREP O&G Holding LLC, which is a wholly-owned indirect subsidiary of AREP, is the owner of 50.01% of the Company’s common stock. Mr. Intrieri graduated from Penn State with a Bachelor of Science degree in Acounting. |
