Experience:
Ms. Nackovic's practice focuses on patent procurement, litigation, and counseling with particular emphasis on litigation under the Hatch-Waxman Act and investigations involving the Federal Trade Commission. She is experienced in technologies involving pharmaceuticals and pharmaceutical formulations, chemicals, diagnostic materials and methods, enzyme formulations, medical devices, transdermal hormone replacement therapies, teeth whitening formulations, and business methods.
Ms. Nackovic has led teams in formulating discovery plans and litigation strategy with the ultimate result of successful outcomes and/or settlements. Her electronic discovery experience includes advice and counseling in the legal and practical aspects of domestic and international electronic discovery obligations. Ms. Nackovic also has experience dealing with blocking statutes, the Hague Convention, and other issues raised by the requirements of international discovery.
Notable Engagements:
Representing a brand pharmaceutical company in an ANDA litigation relating to a transdermal pharmaceutical product.
Drafting license agreements and restructuring the global royalty program for a $12 billion company.
Leading IP due diligence assessments relating to acquisitions and mergers involving complex patent portfolios and approved pharmaceutical products, including extensive document reviews, and inventor and witness interviews.
Providing strategic advice regarding Orange Book listings, patent term extensions, reissues, reexaminations, interferences, and oppositions.
Teaching patent prosecution as a Practicing Law Institute clinic instructor.
