Mr. Wheelwright is a member of the firm's Employment Law Section and chairman of its Immigration Law Practice Group. Based in the firm's Ogden office, he also consults and meets with and represents clients in the firm's other offices in Salt Lake City, St. George, and Las Vegas. His practice is focused in the following areas:
Immigration and Nationality Law
Assists public, private, and multinational companies throughout the United States to secure temporary and permanent work visas for their foreign national employees. His experience includes securing E-1, E-2, E-3, H-1B, H-2A, H-2B, J-1, L-1A, L-1B, O, P, R-1, and TN temporary worker visas, as well as permanent visas (Lawful Permanent Resident status or a "Green Card") under the Outstanding Researcher and Professor, Multinational Manager and Executive, Alien of Exceptional Ability, National Interest Waiver, Member of the Professions Holding Advanced Degrees, Professional, Skilled Worker, Other Worker, and Religious Worker categories.
Advises companies about all aspects of compliance with federal and state employment eligibility verification laws (Form I-9), employer sanctions, and social security "mismatch" letters.
Advises universities and foreign students about a variety of immigration-related issues.
Assists individuals and their family members to secure temporary and permanent immigration status in the United States, including U.S. citizenship.
Assists individuals to secure applicable waivers when they are inadmissible to or removable from the United States.
Appears on behalf of his clients on a regular basis before the U.S. Department of Homeland Security (DHS), U.S. Citizenship and Immigration Services (USCIS), U.S. Immigration and Customs Enforcement (USICE), U.S. Customs and Border Protection (USCBP), U.S. Department of Labor (DOL), U.S. Department of State (DOS), U.S. Embassies and Consulates worldwide, U.S. Department of Justice (DOJ), Executive Office for Immigration Review (EOIR), Immigration Courts, the Board of Immigration Appeals (BIA), United States District Court, and United States Court of Appeals.
International and Domestic Adoptions
Prepares and files orphan petitions (Form I-600 and I-600A) with USCIS and U.S. Embassies and Consulates worldwide for international adoptions.
Represents clients in private-placement, agency, and step-parent adoptions before the Utah State Courts.
General Business Transactions
Assists clients to form and maintain business entities and drafts agreements and other documents related to those entities.
Mr. Wheelwright also has substantial experience in employment law and commercial and probate litigation.
