At Kenyon & Kenyon, Tom Makin's primary area of practice is patent litigation. On a regular basis, his litigation responsibilities include: taking and defending depositions; writing briefs for both trial and appeals courts; and preparing fact and expert witnesses for deposition and trial.
Recent cases on which Mr. Makin has worked include: Soundview v. Sony et al. (D. Conn.) (summary judgment of noninfringement for Sony); Leapfrog v. Fisher-Price (D. Del.) (bench trial of no infringement and patent invalidity for Fisher-Price; affirmed on appeal); Abbey v. Mercedes-Benz et al. (D. Fla.) (summary judgment for defendants); Paice LLC v. Toyota et al. (E.D. Tex.) (jury verdict of no infringement on eight of ten claims; denial of injunction on behalf of Toyota; pending appeal).
Mr. Makin also works on non-infringement, invalidity, and unenforceability opinions; counsels clients on the relative value of issued patents in targeted technical fields; advises clients regarding trade secret issues; and participates in licensing and settlement negotiations stemming from patent ownership and litigation. His responsibilities in those legal areas generally include: preparing licensing and settlement agreements; analyzing complex financial data; and researching legal and technical issues.
Mr. Makin's practice covers a range of technological fields, including: automotive design, with a focus on hybrid vehicle systems; display technology; computers and video game systems; digital cameras; medical imaging devices; children's toys; and web-based business methods. |
