Experience:
Terry W. Ahearn is a partner in the law firm of McDermott Will & Emery LLP based in the Silicon Valley office. He is a member of the Intellectual Property, Media & Technology Department and concentrates his practice on intellectual property litigation and other complex commercial litigation related to high technology.
Terry represents clients in a variety of high-tech industries, including semiconductor, telecommunications, optical networking and electronic gaming. Terry has successfully represented clients in state and federal courts, before the International Trade Commission and in arbitration and mediation proceedings.
Terry is a member of the Firm's Technology Committee. Terry also sits on the board of directors for an international adoption organization. Terry is a member of the state bar of California and is admitted to practice before the United States District Court for the Northern District of California.
While in law school Terry was an articles editor with the Santa Clara Law Review. He also authored an article entitled "Dilution By Blurring Under the Federal Trademark Dilution Act of 1995: What Is It? and How Is It Shown?" 41 Santa Clara Law Review, 893 (2001). Terry is a regular contributor to the Firm's monthly publication, IP Update.

Represented a legal support services company in defense of claims of trade secret misappropriation and unfair competition resulting in resolution at mediation. Responsible for case management, strategy, depositions, motion practice, hearings and briefing.
Represented an international optical networking company in defense of breach of contract claims resulting in a non-monetary settlement of all claims. Responsible for case management, strategy, discovery, motion practice and briefing, including two successful demurrers.
Represented a leading manufacturer of electronic gaming devices in an international arbitration of a patent license dispute. Responsible for case management, strategy, discovery, motion practice, depositions, witness preparation, briefing. Co-counsel at arbitration hearing.
Represented an international optical networking company in a stock transfer and intellectual property cross-license agreement,. Responsible for due diligence, drafting and negotiation.
