Mr. Kiwala is a member with extensive environmental, insurance, pharmaceutical and commercial litigation experience. He has handled cases involving environmental coverage, insurance, and pharmaceutical and medical devices. Mr. Kiwala has also handled cases involving commercial disputes and consumer fraud.
Mr. Kiwala has also been a featured speaker and author on various topics including:
Environmental Coverage given to the Chicago Bar Association;
Federal Procedural Law given to the American Bar Association meetings in New York and New Orleans; and
Construction Litigation given to the Illinois Institute for Continuing Legal Education.
Experience
After an Appellate Court clerkship, Mr. Kiwala handled a wide array of civil litigation from the trial court level to the Supreme Courts in Illinois, Indiana and Iowa and various U.S. Courts of Appeals.
Mr. Kiwala has tried cases in the state and federal courts of Illinois and has appellate experience in Illinois, Indiana, Iowa and before the Fifth, Sixth and Seventh Circuit Courts of Appeal.
He has successfully defended medical device and medical malpractice cases, and has successfully defended sexual discrimination and harassment litigation. His extensive litigation experience includes the defense of trade secrets and other confidential information cases, the defense of commercial lenders, the defense of asbestos cases, and the defense of insurance companies in coverage disputes.
Mr. Kiwala became personally involved in insurance coverage actions filed by some of the country's major asbestos manufacturers, including United States Gypsum Company, Raymark, Inc., UNARCO, Inc. and Forty Eight Insulations. He has also handled major RCRA and CERCLA hazardous waste coverage actions throughout the Midwest, including cases pending in the state and federal courts in Illinois, Indiana, Ohio, Wisconsin and Iowa.
Mr. Kiwala was appointed to and served on the American Bar Association Joint Task Force on Environmental Coverage Litigation commencing in 1991. He was appointed by the ABA to negotiate with 37 attorneys from across the country to draft a joint protocol to handle and dispose of environmental coverage claims in an efficient manner. In 1996, the Joint Task Force issued its Protocol to the American Bar Association and to the Courts across the country for use in handling environmental coverage claims.
He has been an elected member of the Federation of Defense and Corporate Counsel (FDCC) since 1986.
