Stuart Rozen is an experienced transactional attorney and corporate advisor whose practice is primarily focused on corporate reorganizations and financing transactions.
Stuart represents secured and unsecured creditors in loan restructurings, workouts and bankruptcy proceedings. His experience includes representation of commercial banks, lending consortiums, asset-based lenders, real estate developers and loan restructurings, workouts and trade creditors. He negotiates and implements adequate protection orders and debtor-in-possession financing agreements; prepares and litigates motions for relief from automatic stay; prepares disclosure statements; negotiates and implements plans of reorganization; and generally represents the rights of creditors. Stuart’s recent actions include representations of lenders under synthetic lease transactions to Oxford Automotive, Inc., AMERCO and AMERCO Real Estate Company, Fruit of the Loom, Owens Corning and Acme Steel; representation of secured lender to Tru Serv Corporation; representation of administrative agent in Tokheim Corporation and representation of subordinated debt holder in Telesphere Communications, Inc. He also represents debtors in Chapter 11 reorganization cases, including representation of DirecTV Latin America, Paging Network, Inc., Namco Cybertainment, Inc., and Houston Convenience, Inc.
Stuart represents and counsels various lenders regarding bankruptcy risks inherent in various financing transactions; advises clients regarding protection against such risks.
