Scot A. Duvall counsels clients regarding protection of their brands, software, Internet domain names and other intellectual property assets. Having practiced in the field of intellectual property for more than 15 years, Mr. Duvall represents clients in pre-litigation disputes, as well as in litigation and appeals. He serves as local counsel for various cases in Kentucky federal courts. In the recent trademark case Moseley v. V Secret Catalogue interpreting the Federal Trademark Dilution Act (FTDA) , Scot Duvall served as co-counsel in the U.S. Supreme Court, obtaining a unanimous 9-0 decision for the Petitioner. He also represents clients in the U.S. Trademark Office, the Trademark Trial and Appeal Board and the Copyright Office. Mr. Duvall also performs transactional work involving intellectual property, including licensing, contracting, due diligence and negotiations of IP related aspects of business transfer agreements.Mr. Duvall serves as an Adjunct Professor of Law at the University of Louisville’s Brandeis School of Law, teaching several courses in the field of intellectual property. He is a frequent seminar presenter and panelist, having appeared for ALI-ABA, the International Trademark Association, the Washington College of Law at American University, the National Business Institute, the Louisville Bar Association, the Kentucky Bar Association and the Kentucky Library Association. He has published numerous articles regarding trademarks, copyrights, the Internet, obscenity law and first amendment issues.Scot Duvall is active in efforts toward the ongoing development of trademark law. He is Vice Chair of the Dilution and Well-Known Marks Committee of the International Trademark Association (INTA) and serves on the Executive Council of INTA’s Policy Development and Advocacy Group. Mr. Duvall is a co-author of the Kentucky chapter of INTA’s treatise State Trademark and Unfair Competition Law. He was a featured presenter at INTA’s Trademark Dilution Forum 2003, during which he discussed the Moseley decision and advocated significant revisions to the FTDA. Later, Mr. Duvall was appointed to serve on INTA’s Select Committee on the FTDA, which evaluated existing trademark dilution law and proposed specific legislation to revise the federal statute. He was actively involved in crafting federal legislation, the Trademark Dilution Revision Act (TDRA), which Congress passed to improve and clarify the FTDA. |
