Roy is a partner in the litigation department and leads the department's real estate, construction, land use and environmental litigation practice group. He focuses his practice on land use and zoning litigation, construction arbitration and litigation, and condemnation actions. He has represented numerous property owners in claims arising from zoning or re-zoning decisions of local governments, as well as before administrative boards in Charlotte, Huntersville, Cornelius, Pineville, Matthews and other North Carolina cities regarding ordinance interpretation, zoning variances, subdivision, and zoning issues. Roy has also represented numerous developers of residential communities before courts and administrative boards in disputes with lot owners and homeowners associations, including issues regarding amenities, open spaces, and private streets. In addition, Roy has represented property owners and governmental entities in condemnation cases.
Roy is a frequent writer and speaker on construction, land use and zoning topics, and has served as an arbitrator and mediator in numerous construction and contract disputes.
Representative Matters
Represented owners of SouthPark, Charlotte's premier retail mall, in a suit brought by a neighborhood group opposing rezoning decision permitting a $100 million expansion of the mall.
Represented large supermarket chain in amendment and preservation of vested rights under conditional use permit.
Represented subcontractors in lien and payment bond enforcement actions in connection with luxury hotel project.
Represented construction manager in owner's multi-million dollar suit arising from construction of office project in Columbia, S.C.
Represented owner of a residential community in construction claims asserted by site work contractor.
Represented owner and developer of residential community in claims against surveyor and engineer regarding land development, storm water management, and wetlands issues.
