Robert P. Mallory is a partner in the law firm of McDermott Will & Emery LLP based in the Firm's Los Angeles office. As partner in the Trial Department, Robert focuses his practice on antitrust and trade regulation, unfair competition, contract, professional liability, securities and insurance coverage litigation. His experience includes complex multi-party, multi-state and class action litigation. He has tried many cases (including two class actions) to judgment before both state and federal courts, frequently to juries, winning defense verdicts for clients faced with exposure above $250 million and client recoveries ranging to $20 million. His class action experience, in both state and federal courts, is extensive (exceeding 200 separate cases); and includes both putative consumer classes, as well as quasi-class actions brought under private attorney general and qui tam statutes. He is ranked as a leading lawyer in the 2006 edition of Chambers USA for commercial litigation.
Robert has served as lead counsel in numerous antitrust cases, generally for a corporate client, and has defended both grand jury and CID investigations by the Department of Justice. His antitrust experience includes monopolization, attempt to monopolize and predatory pricing cases in the airline, newspaper, stenographic equipment, high school graduation products and sugar industries; price fixing cases in the automobile, sugar, fluid milk, cement, snack foods, industrial gas, plastic pipe, aluminum windows/doors, medical devices and fine paper industries (most of them class actions); dealer termination cases in the piano, automobile parts/supplies, sun care products and newspaper industries; and price discrimination cases in the sugar, paper and fluid milk industries. His unfair competition experience includes the defense of many cases against manufacturers and distributors brought under California's consumer protection laws, such as Business and Professions Code §17200. He has litigated with governmental agencies at all levels, including the Federal Trade Commission, the Department of Justice-Antitrust Division, the Department of Defense, the Department of the Interior, the Department of Energy, the California Department of Water Resources, the California Department of Justice and the City of Los Angeles.
During law school, Robert was an associate editor of the Law Review. He is a member of the State Bar of California, and is admitted to practice before the U.S. Court of Appeals for the First, Third, Seventh, Ninth, Tenth and Federal Circuits, as well as the United States Supreme Court. A longstanding member of the Antitrust and Litigation Sections of the American Bar Association, Robert has written and lectured for the ABA National Institute, the California Continuing Education of the Bar and various local organizations which sponsor continuing legal education. He is a Fellow of the American College of Trial Lawyers.
