He handles a wide-variety of complex commercial disputes with substantial experience representing lenders in suits arising out of commercial loan facilities and creditors in bankruptcy adversary proceedings. This experience includes:
Obtaining summary judgment dismissing claims alleging a duty to lend arising out of a proposal letter and term sheet.
Obtaining the dismissal of counterclaims in a suit arising out of the sale of residential mortgages on the secondary market.
Leading discovery team representing a judgment creditor in a bankruptcy adversary proceeding that culminated in a post-trial decision applying the continuing concealment doctrine to deny debtor a discharge under Chapter 7 of the Bankruptcy Code.
Prior to joining McKee Nelson, Mr. Spitaleri obtained substantial courtroom experience representing indigent tenants in landlord-tenant actions and in affirmative litigation to enforce the Due Process Clause of the U.S. Constitution, New Jersey’s Anti-Eviction Act and regulations promulgated by the U.S. Department of Housing & Urban Development regarding reasonable accommodations for the disabled. |
