Richard Y. Kim is a partner in the law firm of McDermott Will & Emery LLP based in the Washington, D.C. office. As a member of the Intellectual Property, Media & Technology Department, Richard concentrates his practice on trademark prosecution, counseling, licensing and litigation.
Richard assists clients with all stages of securing U.S. trademark protection and coordinates the filing and prosecution of foreign trademark applications. In particular, he has extensive experience in managing large U.S. and international trademark portfolios in the consumer products, technology, scientific, food and beverage, health and entertainment fields, and works with clients in formulating U.S. and international filing, protection and enforcement strategies. Richard advises clients on selection and adoption of new trademarks, renders opinions on the availability and proper use of trademarks and practices extensively before the U.S. Patent and Trademark Office (USPTO), including opposition and cancellation proceedings and ex parte appeals from final decisions of the USPTO.
Prior to joining the Firm, Richard was an examining attorney with the USPTO, where he rendered agency decisions on statutory and procedural issues concerning U.S. trademark applications. He also argued numerous successful ex parte appeals before the Trademark Trial and Appeal Board and served as an instructor for the new examining attorney training program. As recognition for his excellent service, Richard was named the Examining Attorney of the Year for 1999 by the American Intellectual Property Law Association (AIPLA).
Richard is a member of the Virginia State Bar, Intellectual Property Section. He is admitted to practice in Washington, D.C., Virginia and Maryland and before the United States Court of Appeals for the Fourth Circuit.
Richard is fluent in Korean and Spanish.
