W. Nicholas Chen is a partner in the law firm of McDermott Will & Emery LLP based in the Silicon Valley office. As a member of the Intellectual Property, Media & Technology Department, Nicholas focuses his practice on patent procurement, client counseling on infringement and validity matters, and due diligence studies.
Nicholas's practice entails all aspects of patent procurement. He has extensive experience prosecuting patent applications before the U.S. Patent and Trademark Office, including successful arguments before the Board of Patent Appeals and Interferences, in areas of technology including computer software applications, search engines, telecommunication systems, signal processing, electronic circuits and devices, automotive diagnostic systems and networking systems. Nicholas has performed patent infringement and validity analysis for major corporations and has counseled these corporations on how to avoid infringement of various patents. He also has assisted clients in formulating strategies and policies for generating a patent portfolio. Nicholas has experience in reviewing and drafting license agreements.
Prior to entering the practice of law, Nicholas was an electrical engineer and a technical consultant at a multinational computer company, and was responsible for handling patent licensing and prosecuting patent applications.
While attending law school, Nicholas served as both a Patent Law Research Assistant and Student Attorney for the University of Maryland. Nicholas received a bachelor’s degree in electrical engineering.
He is admitted to practice in Maryland, California, the District of Columbia and registered with the U. S. Patent and Trademark Office.
