Nick Whittenburg joined the firm of Miller & Martin in 1990. He became a partner with the firm in 1996 and served as Chairperson to the firm's Bankruptcy and Creditors' Rights Group during 2000 and 2001. In 2001, he became Assistant General Counsel with AmSouth Bank where he directed the defense of all commercial and consumer litigation against AmSouth. Mr. Whittenburg rejoined Miller & Martin as a Member in 2004. The focus of Mr. Whittenburg's practice is commercial bankruptcy, workouts and litigation. His practice includes representing secured and unsecured creditors in bankruptcies and workouts. He has assisted financial institutions, including banks and insurance companies, to recover and protect their collateral. He has also represented manufacturers to defend preference suits and assisted them with unsecured creditors' committee participation. Finally, he has represented parties to various types of contracts that may be subject to assumption, rejection or assisgment in bankruptcy; these include leases, license agreements and francise agreements.
