Contentious Construction Experience:
Acting for the International Joint Venture Main Contractor for a major bridge project in Hong Kong in respect of various disputes with its subcontractors.
Acting for a Korean EPC contractor of a power station in Sohar, Oman in an ICC arbitration for claims for Change Orders and extensions of time.
Acting for a contractor in a large scale arbitration claiming extensions of time and loss and expense relating to the construction of a commercial building in Hong Kong - issues include concurrent delay and implied liability for design.
Advising the Department of Infrastructure of Victoria in relation to contract administration and claims made by contractors for extensions of time and variations arising out of the Regional Fast Rail Project in Victoria. Issues include the interpretation of the project performance specification, variations and delay claims.
Insurance Experience:
Acting for insurers in defending arbitration proceedings arising out of a fire at a market and shopping mall in Hong Kong. Issues include non disclosure and the interpretation of material alteration of risk provisions.
Advising Reinsurers in respect of a claim by the main contractor on its Contract Works and Advance Loss of Profits Insurance Policies following a fire during the construction of a power station in Taiwan.
Acting for a surveyor insured on instructions from Lloyds syndicates including the defence of parallel proceedings in London arising from separate claims from the owner and mortgagee of one building for sums in dispute exceeding £20 million.
