Michael W. McTigue Jr. is a vice chair of the Commercial Litigation Practice Group. Michael focuses his practice on class actions and other complex commercial matters, including communications, securities and corporate governance, products liability and bankruptcy.
Securities Litigation. Michael has defended clients in SEC and state regulatory proceedings on both the compliance and enforcement side. Currently, Michael is actively representing investment company clients (including directors and trustees) in connection with investigations by regulators and in class action proceedings. Michael recently led an independent investigation for an investment management company's special litigation committee. In addition, Michael has represented registered companies and individuals in connection with securities fraud and insider trading allegations, and advises clients on their public disclosure obligations. Michael has also represented audit committees in connection with their obligations under Sarbanes-Oxley.
Communications and Consumer Class Action Litigation. Michael has successfully defended wireless and cable companies in national consumer class action litigation in federal and state courts around the country.
Litigation Highlights. Michael obtained a production injunction in federal court that forced a client's competitor to cease all operations based on international computer software, trade secret and other intellectual property theft. Michael successfully defeated the certification of a national civil rights class action challenging an intercollegiate initial eligibility athletic rule. Michael frequently leads litigation teams in complex bankruptcy related matters. Michael also has expertise in litigation arising from M&A transactions. In addition, Michael serves as outside general litigation counsel for one of the world's leading distributors of laboratory supplies and equipment.
Public Interest. Michael serves on the boards of several nonprofit organizations. He has also represented individuals and organizations on a pro bono basis in a variety of free speech and free exercise matters.
In General. In 2007, BTI named Michael to its Client Service All-Star Team, which singled out 113 lawyers whom in-house corporate counsel identified, unprompted, as delivering unsurpassed excellence in client service. Michael received his undergraduate degree cum laude from the University of Pennsylvania. He graduated cum laude from Boston University School of Law, where he was a G. Joseph Tauro Distinguished Scholar and articles editor of the Boston University Law Review. After graduating from law school Michael completed a one-year clerkship for the Honorable Donald W. VanArtsdalen, United States District Judge for the Eastern District of Pennsylvania.

Michael is a member of the Pennsylvania and New Jersey bars and is admitted to practice before the United States Supreme Court, the United States Court of Appeals for the Third Circuit, and the United States District Courts for the Eastern District of Pennsylvania, the Middle District of Pennsylvania and the District of New Jersey. |
