Michael S. Waters received his B.A. from Columbia College in 1962 and his LL.B. from Columbia Law School in 1965. He was admitted to the bars of the State of New Jersey in 1965, the United States Supreme Court in 1970, and the State of New York in 1984. Mr. Waters is also admitted in the United States Courts of Appeals for the Second and Third Circuits and various United States District Courts. His practice focuses on antitrust, bankruptcy, and commercial litigation. In general commercial matters, he has handled all matter of contract, fraud, and business-related litigation.
Mr. Waters has long maintained an antitrust practice, concentrating in franchising and distribution. He was involved in the preparation, trial and the appeal to the U.S. Supreme Court of the bank merger case, United States v. Phillipsburg National Bank in the early 1970s. Since then, he has represented the interests of manufacturers in numerous lawsuits regarding distribution of their products and relationships with their distributors. In the automobile field, he was involved in the significant New Jersey cases of Tynan vs. General Motors Corporation, and Simmons v. General Motors Corporation.
Mr. Waters has been the attorney for Trustees and Creditors' Committees in a number of bankruptcies. Most frequently, he has been the attorney for creditors and secured creditors. Mr. Waters was appointed receiver by a New Jersey Superior Court Judge in a matter where limited partnership debtors owned over 3,000 tenant units. He successfully distributed the properties and paid all of the allowed claims of creditors in full.
Mr. Waters has represented a number of major insurance companies in all types of insurance disputes, including reinsurance and various coverage disputes.
Mr. Waters is a member of the Essex County Bar Association, the New Jersey State Bar Association and its Franchising Section, the New York State Bar Association, the American and its Forum on Franchising, and Litigation and Antitrust Sections, and the Association of the Federal Bar of the State of New Jersey. |
