Michael House Biography :

Michael P. House is a partner in the law firm of McDermott Will & Emery LLP based in the Washington, D.C. office. He is a member of the Firm’s Global Trade & Cross Border Strategies Practice Group, where his practice focuses on import relief measures, multilateral trade disputes, and export controls.

Michael has represented a wide variety of multinational clients in numerous trade actions arising under the antidumping and countervailing duty laws, the unfair trade and unfair import practices laws, safeguards proceedings, the GSP program and export controls. He represents clients regularly before the U.S. Department of Commerce, U.S. Trade Representative, U.S. International Trade Commission, Customs and Border Protection, and other federal and local agencies. He advises and represents clients in export licensing and foreign availability proceedings before the Department of Commerce and in export transactions before the Treasury Department’s Office of Foreign Assets Control. Michael advises clients with regard to entry, classification, valuation and other customs issues involving U.S. Customs and Border Protection. Additionally, he assists clients in the licensing of exported goods and technical data that are controlled by the U.S. Commerce Department's Bureau of Industry and Security (BIS) and the U.S. State Department's Directorate of Defense Trade Controls (DDTC), including "dual use" commodities and technical data as well as items defined as "defense articles" or "defense services" under the International Traffic in Arms Regulations (ITAR).

Michael has been lead counsel in numerous international trade proceedings that that have presented some of the most complex and novel substantive and procedural issues to arise in this subject area. He has represented major multinational producers in cases that have involved, for example, the proper application of Section 781 of the 1988 Trade Act (anti-circumvention provisions); the adjustment for home market taxes in calculating U.S. price under Section 772 of the Tariff Act of 1930 (including issues of multiplier effect and tax incidence); the proper interpretation of the scope of pre-1988 antidumping duty orders (reconciliation of ITC injury determination scope with class of merchandise investigated by Commerce); and numerous other issues of statutory and regulatory interpretation under the principal U.S. unfair trade laws.

He appears regularly before the U.S. Court of International Trade in actions challenging determinations that involve a wide variety of industry sectors, including such major industries as semiconductors, steel, consumer electronics, chemicals and textiles. In addition, he has argued frequently before the U.S. Court of Appeals for the Federal Circuit and has participated in select international trade cases that have reached the U.S. Supreme Court. Michael is nationally ranked by Chambers USA for his international trade work and the International Who's Who of Trade and Customs Lawyer.

Michael lectures frequently on international trade topics before audiences in Asia, Latin America, Canada and the United States. Prior to joining the Firm, Michael served as co-chair of the International Trade Group of Kaye Scholer LLP.

Michael is admitted to practice in the District of Columbia, and before the U.S. Court of International Trade, the U.S. Supreme Court and the U.S. Court of Appeals for the Federal Circuit. He is a member of the American Bar Association and the American Society of International Law.
