Michael Shen’s practice focuses on all aspects of intellectual property litigation. Mr. Shen has appeared before various federal district and appellate courts and litigated patent cases in many technological areas including electrical connectors, chemical processes, medical devices, and pharmaceuticals, as well as trade secret and trademark cases.
Mr. Shen counsels clients on intellectual property matters, including rendering legal opinions on patent infringement and invalidity issues, and negotiating and drafting licenses and settlement agreements. Mr. Shen also has experience conducting interference proceedings and prosecuting patents before the U.S. Patent & Trademark Office. Representative technologies include electrical connectors, biotechnology, industrial chemicals, polymer chemistry, photo film, semi-conductor processing, batteries, and pharmaceuticals.
Mr. Shen also devotes time to pro bono matters and is currently acting as lead counsel in a capital appeal to the Virginia Supreme Court.

FCI USA v. Tyco Electronics (E.D. Tex. 2006). Representing FCI in patent, trademark, and unfair competition case relating to shieldless, high speed backplane electrical connectors.
Impax v. Aventis (Fed. Cir. 2005). Representing appellant Impax in appeal relating to riluzole, a drug used for treating Lou Gehrig’s disease.
Calmedica v. Novoste (N.D.Ga. 2004). Representing defendant in case relating to catheter systems.
Air Liquide America v. P.H. Glatfelter (M.D.Pa. 2004). Represented patentee Air Liquide in case relating to process for bleaching wood pulp using ozone. Obtained favorable settlement.
FCI USA v. Foxconn Electronics (N.D.Cal. 2003). Represented patentee FCI in a case relating to BGA electrical connectors. Obtained favorable settlement.
FCI USA v. Hon Hai Precision Industry (N.D.Cal. 2001). Represented patentee FCI in case relating to BGA computer sockets. Obtained summary judgment of infringement and jury verdict of willful infringement with past damages award of $8 million.
FCI USA v. Samtec (S.D.Ind. 2001). Represented FCI in patent and trademark case relating to BGA electrical connectors. Obtained favorable settlement.
BASF AG v. Reilly Industries (S.D.Ind. 2001). Representing patentee BASF AG in case relating to process for making PVNO.
Laerdal Medical v. Philadelphia Cervical Collar (D.N.J. 1999). Represented Laerdal Medical in patent and trade secret case relating to cervical collars. Obtained favorable settlement.
Alcon Labs. v. Bausch & Lomb (N.D.Tex. 1999). Represented patentee Alcon Labs. in case relating to Tobradex eyedrops. Obtained preliminary injunction. |
