Mitch represents businesses and individuals in complex commercial and business litigation in state and federal courts. He has gained experience prosecuting and defending breach of contract cases; fraud actions; employment disputes; partnership disputes and other business-type divorces; franchisor/franchisee disputes; unfair competition, trademark and trade secret claims; oil and gas cases; commercial landlord/tenant disputes; and UCC contract disputes. Mitch has also briefed six appeals in various Texas courts of appeals for both appellants and appellees.

Representative Experience

Obtained temporary injunction at a two day hearing prohibiting several defendants from taking action to destroy client's business.

Recovered quarter of a million dollar deposit paid to manufacturer of sophisticated valve-testing equipment when manufacturer failed to make timely delivery.

Obtained numerous settlements on behalf of provider of coin-operated laundry equipment against landlords for breaches of commercial leases.

Successfully prevented nonresident competitor from using Texas client's trademark and trade name.

Represented appellant in an appeal to the Texas Fourteenth Court of Appeals resulting in the court vacating an attorneys' fee award, which was over 90% of the total amount awarded by the trial court.

Represented appellee in an appeal to the Texas Fourteenth Court of Appeals resulting in the court affirming the majority of trial court's order denying defendants' motion for summary judgment based on their qualified and official immunity defenses to claims for violation of appellee's rights under the First and Fourteenth Amendments to the United States Constitution.
