Health Care Litigation
Maureen Vogel focuses her trial practice on hosptial and physician negligence actions, products liability, premises liability and personal injury litigation. She also handles matters involving hospital compliance with state and federal regulations and physician credentialing issues. She has represented clients in Missouri and Kansas state courts as well as Missouri and Kansas federal courts. Before joining the Firm, Ms. Vogel served as judicial clerk to the Honorable Harold L. Lowenstein at the Missouri Court of Appeals-Western District.

McClafferty v. Lee’s Summit Hospital - Defense Verdict
Circuit Court of Jackson County, Missouri, Case No. CV9321231
Obtained one of the top defense verdicts of the year for hospital client. Plaintiff alleged hospital client and other healthcare providers failed to appropriately diagnose and treat her for intracranial bleed resulting in motor and cognitive deficits. Jury found in favor of hospital.
Cammisano,et al. v. Trinity Lutheran Hospital, et al. - Defense Verdict
Circuit Court of Jackson County, Missouri, Case No. 98CV022737
Plaintiffs alleged negligence and wrongful death against hospital client and other healthcare providers based on administration of narcoleptic medications and failure to appropriately monitor plaintiffs’ adult son during psychiatric admission for bipolar disorder. Jury found in favor of defendants.
Berry, et al v. Providence Medical Center, et al.
District Court of Wyandotte County Kansas, Case No. 96C642
Plaintiffs alleged negligence against obstetrician client and others in connection with forceps delivery of infant resulting in complete brachial plexus injury. Jury awarded plaintiff’s damages for only the medical care of the 2 year-old child. This was an extremely low verdict for a birth injury case.
Biscanin, et al. v. White, D.O., et al. - Dismissal of our physician client during trial
District Court of Wyandotte County Kansas, Case No. 96C4863
Plaintiffs alleged negligence and wrongful death against physician client based on failure to order psychiatric hold for patient during emergency treatment of gastro-intestinal complaints. Patient later committed suicide. Physician client was dismissed by plaintiffs on third day of trial. No payment was made on his behalf.
Harris v. Trinity Lutheran Hospital Settlement at trial
Circuit Court of Jackson County, Missouri Case No. CV98027992
Case settled in court upon terms very favorable to client after the judge advised plaintiff’s counsel that he would likely grant defendant’s motion for directed verdict at the close of plaintiff’s case.

Nguyen v. Walker, M.D.
District Court of Wyandotte County, Kansas, Case No. 98C5863
Physician client granted summary judgment. The Court found that the case was time-barred based on application of Kansas discovery rule.
Thompson v. Research Medical Center
Circuit Court of Jackson County, Missouri, Case No 0516CV18575
Motion to Dismiss granted based on assertion that the plaintiff’s cause of action was time-barred. Affirmed by the Western District Court of Appeals. Plaintiff’s Application for Transfer to the Missouri Supreme Court denied.

Circuit Court of Jackson County, Missouri, Case No. 02CV212465
Motion to Dismiss filed based on statute of limitations. Plaintiff responded by filing dismissal of our hospital client.

Motion for Summary Judgment filed arguing plaintiff failed to state a cause of action for agency against hospital. Plaintiff responded by filing dismissal for our client.
