Professional Experience
Ms. Doty counsels public and private employers on the many and varied aspects of employment relationships and also litigates all types of employment cases. She offers preventative advice to employers on issues such as hiring, wage and hour matters, employee classification, employee handbooks, trade secrets and restrictive covenants, family, medical and pregnancy leave requirements, reductions in force, termination decisions, and separation agreements. She litigates a wide variety of employment matters including wrongful termination, age, gender, race and disability discrimination, sexual harassment, public policy, and wage and hour claims in the state and federal courts. In addition, she handles administrative matters before the California Labor Commissioner, Cal-OSHA, and the Workers´ Compensation Appeals Board.
In 2004, Ms. Doty successfully tried a wrongful termination in violation of public policy and disability discrimination case to a jury in the United States District Court.
Outside the labor and employment field, Ms. Doty also practices business litigation with an emphasis on franchise law. Her franchise work for oil companies involves all kinds of franchise terminations and nonrenewals under the Petroleum Marketing Practices Act (PMPA), as well as contract and tort claims related to petroleum franchise relationships. In connection with this litigation, she has also been involved in real estate transactions on behalf of franchisors divesting service stations, including negotiating environmental indemnities with the SBA and other lenders.
Ms. Doty also has an appellate practice in the state and federal courts which has included appeals in the areas of employment, toxic torts, medical malpractice, business torts, property contamination, indemnification claims, and attorneys´ fees and sanctions issues.
