Mark Chavez focuses on issues of insolvency and reorganization. He represents both secured and unsecured creditors in complex Chapter 11 reorganizations and in Chapter 7 liquidations, both pre and post-petition. He has represented a major energy company in Chapter 11 bankruptcy proceedings where the primary issue was the proper status to afford the debtor’s various environmental liabilities. Mr. Chavez also works on complex commercial litigation involving various non-bankruptcy issues, including energy matters and contract disputes. Represented judgment-creditor in collection efforts, resulting in recovery of 80% of outstanding judgment. Facilitated removal of creditor’s property from debtor’s estate, pre-bankruptcy, and facilitated movement of such property to subcontractor in Canada. Represented parties holding indemnification claims against debtors in bankruptcy arising from the parties’ pre-petition contractual relationships.
