Ms. Chun’s practice focuses on complex civil litigation, with an emphasis on business disputes, unfair business practices, employment law, and appellate litigation. General Civil Litigation Ms. Chun has handled a wide variety of cases in the trial and appellate courts, both state and federal, including disputes involving breach of contract, fraud, business torts, trade secrets, unfair competition, professional malpractice, securities, First Amendment, and real property-related claims. She has prevailed on behalf of clients in numerous dispositive motions and at trial. Clients represented include businesses, banks, new media and software companies, retailers, start-ups, developers, commercial landlords and tenants, law firms and individuals. Class Action and Unfair Business Practice Litigation Ms. Chun defends business clients in consumer class action litigation and against claims of unfair and fraudulent business practices. Representative matters include winning a dispositive motion in an action alleging unfair business practices, antitrust and consumer protection law violations; resolving an unfair business practices action prosecuted by a municipality for a fraction of the demanded tens of millions of dollars in penalties; and the defense of clients in various consumer class actions alleging unfair service rates or late fees, false advertising, price fixing and for violations of consumer protection laws. Employment - Ms. Chun defends employers in wrongful termination, discrimination, sexual harassment, wage and hour, whistleblower and other types of disputes. She has prevailed at trial and at administrative hearings on wage and hour claims; has won summary judgment on sexual harassment, sex discrimination, constructive discharge, and tort claims; and has secured highly favorable pre- and post-litigation settlements in favor of employers. Ms. Chun also counsels employers, with the goal of avoiding or minimizing litigation risk, and provides clients sexual and other harassment prevention training. Ms. Chun also represents individuals with respect to the negotiation of employment agreements and severance packages. |
