Mr. Jenkins has practiced law for the past 24 years in the areas of commercial litigation and bankruptcy and chapter 11 reorganizations, including the negotiating, structuring and formulating reorganization plans, the recovery, assembly and distribution of estate assets, as well as a broad range of creditor representations in corporate bankruptcies and insolvencies. Mr. Jenkins also has extensive experience in the areas of pre-filing our out-of-court workouts and has advised numerous large creditors in such matters. In the mid-1990s, Mr. Jenkins assisted in his law firm’s representation of America West Airlines in its post-confirmation litigation and plan implementation activities. He also served as lead reorganization counsel to the chapter 11 Trustee in the hotly-contested and highly publicized reorganization proceeding of Cajun Electric Power Cooperative, Inc. in Baton Rouge, Louisiana. In the late-1990s, Cajun Electric was one of the largest and most extensive chapter 11 bankruptcy cases ever filed, requiring the Trustee and his advisors to assemble, administer and formulate a vehicle for distribution of assets valued in excess of $1 billion to creditors holding claims in excess of $5 billion. In that representation, Mr. Jenkins supervised and coordinated the efforts of dozens of attorneys at several different law firms. In recent years, Mr. Jenkins has represented various creditor constituencies in insolvency proceedings, including secured creditors, unsecured creditors, creditors’ committees and indenture trustees. He has made numerous arguments at the United States Court of Appeal for the Tenth Circuit, the Bankruptcy Appellate Panel for the Tenth Circuit, and the United States Court of Appeal for the Fifth Circuit. Most recently, Mr. Jenkins has undertaken representations for commercial litigation clients, defending against a lender liability claim, pursuing claims of defrauded investors, as well as pursuing avoidance actions under the provisions of the bankruptcy code. In addition, Mr. Jenkins currently is assisting in the firm’s bankruptcy representation of affiliated debtors in a complex mortgage loan servicing enterprise. Mr. Jenkins has been included on the list of The Best Lawyers in America 2007 in Bankruptcy and Creditor-Debtor Rights Law and has been voted by his peers throughout the state as one of Utah's "Legal Elite" in the category of Bankruptcy/Workout (as published in Utah Business Magazine).
