Lauren Dwyer's commercial litigation practice emphasizes complex matters involving accountants' professional liability, business crimes and product liability. She has defended accounting clients against allegations of fraud, breach of fiduciary duty and civil RICO claims. She has also defended individuals in criminal and civil investigations by state and federal authorities as well as represented individuals and companies in internal investigations. As part of her work in complex civil litigation, Lauren has been involved in multi-jurisdiction product liability work.
Prior to joining Foley Hoag Lauren served as Law Clerk to the Honorable Nancy Gertner, United States District Court for the District of Massachusetts, and interned at the United States Attorney's Office for the District of Massachusetts.

The following is a brief summary of Lauren's experience and accomplishments:
Represented officer and employees of various companies in state and federal criminal investigations regarding public highway construction, including representation at state, federal, and grand jury
Represented various pro bono clients, particularly helping victims of domestic violence obtain and enforce restraining orders in district, probate and superior courts. In related proceedings, worked to preserve confidentiality of victim's medical and mental health records, and in one matter secured a monetary award for victim based on identity theft claims
Represented employee in internal investigation regarding stock option practices
Conducted depositions, fact and expert discovery, and drafted dispositive motions in representing a pharmaceutical company in products liability suits pending in multiple state and federal jurisdictions
Successfully represented at a four-week jury trial a Big Four accounting firm and its engagement partners against allegations of fraud, breach of fiduciary duty and civil RICO. In a case arising from the bankruptcy of a multi-million public company, plaintiff-investors claimed that the company's financial statements were materially mistated with regard to complex issues of purchase accounting, and revenue recognition and reserves relating to government payors. After a trial in which plaintiffs sought in excess of $400 million, the jury returned a verdict exonerating the firm and its partners of fraud, breach of fiduciary duty and civil RICO, and awarded only a small fraction (less than 10%) of the amount demanded by plaintiffs in settlement on the remaining negligence-based claim. Lauren was particularly involved with preparation of fact and expert witnesses on issues relating to purchase accounting and Medicare regulations.
