Kristen has worked on matters arising under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA or Superfund), the Resource Conservation and Recovery Act (RCRA), the Clean Water Act (CWA), the Oil Pollution Act (OPA), the Endangered Species Act (ESA), the National Environmental Policy Act (NEPA), the Administrative Procedures Act (APA), the Clean Air Act (CAA), and the Dormant Commerce Clause. Kristen’s practice focuses on environmental law, natural resources law, land use, and health and safety matters, with a particular emphasis on Natural Resource Damages litigation, Dormant Commerce Clause litigation, federal land use planning and litigation, and hazardous and solid waste issues under RCRA, CERCLA, and state laws and regulations. Kristen’s experience includes representing and counseling clients on the following matters:Natural Resource Damages claims under CERCLA, CWA, and OPA Remedial Investigations/Feasibility Studies(RI/FS) and Remedial Design/Remedial Actions under CERCLA Negotiating Consent Decrees under CERCLA Acquisition of federal funds for the cleanup of Superfund sites Flow control laws and other importation/exportation bans on solid, hazardous, and radioactive wastes RCRA and CAA enforcement proceedings Voluntary cleanup efforts (VCUPs) Ski area permitting, regulation, and development on National Forest System lands Audits regarding compliance with state and federal environmental laws and regulations Submitting comments on proposed rulemakings Federal land use planning and litigation Oil and gas leasing Administrative appeals of BLM oil and gas decisions Land use, zoning, and Planned Unit Development (PUD) issues Prior to joining the firm, Kristen: Assisted in preparing a brief and oral arguments for a wetlands case before the United States Supreme Court that involved a Fifth Amendment Takings issue (2001) (Palazzolo v. Rhode Island ,121 S.Ct. 2448, 150 L.Ed.2d 592, 69,U.S. Supreme Court) Worked for a Colorado manufacturing company on EPA and OSHA compliance matters Participated in the Institute for Public Representation, a Georgetown clinic, where she represented citizen groups involved in environmental disputes. |
