Kevin Smith focuses his practice on defending employers in employment discrimination litigation in federal and state courts. Kevin also provides counseling to employers concerning local, state, and federal employment laws, and assists employers in responding to charges of discrimination filed with administrative agencies, including the Equal Employment Opportunity Commission and the Florida Commission on Human Relations. He has defended clients across a wide range of matters involving discrimination, whistleblower retaliation, Equal Protection, USERRA, violations of the Fair Labor Standards Act, the Fair Credit Reporting Act, the Drivers' Privacy Protection Act, non-compete agreements, and intentional torts, including defamation and fraud in the inducement. Kevin also has extensive experience with handling large, nationwide collective actions under the Fair Labor Standards Act.
Kevin also has experience in the traditional labor area, providing defense and advice to employers covered by the National Labor Relations Act regarding their rights and obligations. Kevin has also assisted employers with various union avoidance programs.
Kevin is admitted to practice in Florida and before the U.S. District Court for the Southern, Middle, and Northern Districts of Florida. He is a member of the Equal Opportunities Law Section, the Labor and Employment Law Section, and the Young Lawyers Division of the Florida Bar. He was listed in Florida Trend magazine as an "Up and Coming" lawyer in its 2007 "Florida Legal Elite" listing.
During law school, Kevin was the Administrative Editor of the Georgetown Journal on Poverty Law and Policy. He received the Georgetown Award for Outstanding Public Service in 2000 for his volunteer work with local children from low-income families.
