Kenneth Barker is a senior managing director in the FTI Forensic and Litigation Consulting practice. He is based in Dallas and maintains an office in Nashville. Mr. Barker serves as leader of the FTI health care industry practice group and specializes in assisting legal counsel in the conduct of special investigations and in the defense of health care providers. He also has substantial experience in helping health care providers and pharmaceutical companies design and implement compliance monitoring systems resulting from corporate integrity agreements (CIAS) mandated by the Office of Inspector General (OIG).
Mr. Barker has been working with HCA (formerly Columbia/HCA) and its various outside law firms since September 1997 on all aspects of the various government investigations and private payer and health and welfare fund litigations. He has led teams that have investigated all allegations raised by the plaintiffs and has developed numerous methodologies for resolving the complex reimbursement issues. He has spent considerable time negotiating the contours of these methodologies with the Department of Justice, Centers for Medicare and Medicaid Services, many chapters of the Association of the United States Army, state Medicaid agencies and private payers. He has also assisted HCA in the design and negotiation of its CIA, working with the OIG.
Mr. Barker is currently assisting a large pharmaceutical manufacturer facing a series of government investigations and private litigation concerning its sales and marketing (including pricing) practices. He has also provided similar services to other large healthcare providers and pharmaceutical companies, and he has also helped a number of other major companies respond to and resolve a wide variety of government allegations. In addition to those in the health care industry, his clients have included contractors for the Department of Defense.
In addition to his work in these regulated industries, Mr. Barker has served clients in the airline industry, the tobacco industry and the Ministry of Justice of a Middle East country. In general, Mr. Barker worked on teams for outside counsel on special investigations and/or the quantifying of monetary loss or damage.
Mr. Barker received a B.S. in accounting and economics from Pennsylvania State University. He is a certified public accountant and a member of the Health Care Compliance Association. He is an associate member of the American Bar Association, Litigation Sections Healthcare Law. |
