Kendall, a shareholder in the Madison office, focuses on complex business litigation, with an emphasis on insurance, reinsurance and class action issues. His practice also concentrates on media and constitutional litigation at both the trial and appellate levels. He has successfully represented clients on a wide variety of matters before the Wisconsin Supreme Court, Wisconsin Court of Appeals and Seventh Circuit Court of Appeals. Currently, Kendall is defending clients in class action litigation in Wisconsin, Illinois and Arkansas. Through these lawsuits, he has become familiar with the Class Action Fairness Act of 2005 ("CAFA"), a law on which he now regularly writes and speaks. In the reinsurance arena, Kendall's most recent work includes a case before the Seventh Circuit regarding consolidation of arbitration proceedings. Several years ago, he successfully represented Employers Insurance Company of Wausau in Employers Insurance Company of Wausau v. American Re, 256 F. Supp. 2d 923 (W.D. Wis. 2003), one of the country's few decisions on the topic of declaratory judgment expenses. In his media and constitutional practice, Kendall has obtained several key appellate decisions helping to preserve Wisconsin's tradition of open government: Linzmeyer v. Forcey, 2002 WI 84; and Jensen v. School Dist. of Rhinelander, 2002 WI App 78. In election years, Kendall works with television and radio stations on compliance with political broadcasting regulations. Periodically, Kendall teaches Constitutional Law at the University of Wisconsin Law School.
Prior to joining the firm, Kendall served as counsel to the Supreme Court of the Republic of Palau and spent two years as a law clerk for the Honorable Barbara B. Crabb, U.S. District Court Judge for the Western District of Wisconsin.
Kendall graduated cum laude from Duke University and earned his J.D. from the University of Wisconsin Law School, where he served as the Senior Articles Editor of the Wisconsin Law Review and was a member of Order of the Coif.
