Kelly Broder is an associate in the law firm of McDermott Will & Emery LLP based in the Firm's Washington, D.C. office. She is a member of the Firm's Health Law Department.
Prior to joining McDermott, Kelly was an associate in a Nebraska law firm. Kelly served as counsel to academic medical centers and specialty hospital and physician group practices. There, she reviewed and drafted hospital procedures, medical staff bylaws, physician-hospital service agreements, physician recruitment agreements, outsourcing agreements, articles of incorporation, and operating agreements. Kelly has experience researching and analyzing state regulations of hospitals, licensure and certification issues as well as the Ethics in Patent Referrals Act ("Stark"), the Medicare and Medicaid Patient and Program Protection Act ("Anti-Kickback Statute"), the Health Insurance Portability, Emergency Medical Treatment and Active Labor Act, and the False Claims Act. Kelly participated in a QIO hearing regarding an alleged violation of the Emergency Medical Treatment and Active Labor Act and a False Claims Act investigation.
Kelly also holds experience in conducting research and drafting discovery, pleadings, trial briefs, and an appellate brief. She has attended hearings and processed subrogation cases.
While in law school, Kelly was a brief writer for the Jessup International Moot Court.
Kelly is a member of the Omaha Chapter of United Cerebral Palsy Executive Committee and a Board Member for the Omaha Community Playhouse Rising Stars.
