Keith Walter is a senior associate with the Litigation & Dispute Resolution Group. Mr. Walter's practice is primarily focused on litigation and client counseling. Mr. Walter's litigation experience includes patent, trademark, copyright and trade secret matters encompassing a variety of diverse technology areas including pharmaceuticals, medical devices, consumer electronics, mechanical processes, computer software and fashion. In the patent litigation arena, Mr. Walter most recently served as lead counsel where he represented Linzer Products, Corp. in a patent license dispute. The case was favorably resolved after Linzer defeated defendant’s motion to dismiss. In the pharmaceutical area, Mr. Walter has litigated both Hatch-Waxman and conventional non-Hatch-Waxman pharmaceutical lawsuits. Most recently, Mr. Walter obtained a temporary restraining order in Hatch-Waxman action against two competitor drug companies. In addition to his patent experience, Mr. Walter has been involved in the use of copyrights and trade secrets to protect computer software and has experience in litigating such matters, including Niksun, Inc. v. Intellic Networks, Inc. in which the firm represented Niksun. Mr. Walter also provides Delaware litigation counsel services in intellectual property disputes before the United States District Court for the District of Delaware, where Mr. Walter has represented, a number of parties both. Most recently, Mr. Walter obtained summary judgment of inequitable conduct in a case involving semiconductor manufacturing equipment. Mr. Walter also counsels clients on managing and protecting their intellectual property. For example, Mr. Walter advises clients in connection with the evaluation of inventions for patentability, product clearance evaluations, procurement of intellectual property rights, patent infringement and validity studies, and the licensing of intellectual property rights. |
