Kathleen Cavanaugh is a member of the firm’s Litigation, Banking & Financial Services and Bankruptcy & Creditors’ Rights Groups. She represents individuals and corporations in commercial litigation involving contracts, lender liability, debt collection, consumer fraud and bankruptcy law. A primary focus of Kathleen’s practice is the representation of banks and consumer financial services companies in defense of consumer fraud, lender liability and similar claims in federal and state courts and at the trial and appellate levels. Kathleen’s practice includes the defense of class actions involving issues relating to state consumer protection statutes and regulations, as well as the federal Truth In Lending Act, Home Owners Equity Protection Act and Real Estate Settlement Procedures Act.
Kathleen defended a mortgage banking company in a putative class action in federal court involving alleged violations of the New Jersey Consumer Fraud Act, New York Deceptive Practices Act and Federal Truth in Lending Act, as well as related state statutes and regulations. She also represents motor vehicle finance companies regarding diverse issues arising out of motor vehicle dealership failures and dealership breach of trust obligations. |
