Lead counsel in an 10 week arbitration for Ford Motor Company against a supplier of software seeking damages in excess of $75 million. Following Claimants' presentation of evidence, succeeded in obtaining dismissal of $50 million of claimed damages.
Co-lead counsel for Blue Cross Blue Shield of Michigan in two putative national class actions and one state class action commenced by physicians and other health care providers against alleging RICO violations arising out of payment of claims.
Lead Michigan counsel for The Dow Chemical Company in a putative class action alleging dioxin contamination of property, during which Michigan Supreme Court issued opinion precluding claims for medical monitoring where no present physical injury.
Lead Michigan counsel for Lorillard Tobacco Company in trademark infringement litigation from sale of counterfeit cigarettes. Obtained published decision from the 6th Circuit overturning the lower court's denial of injunctive relief.
Lead Michigan counsel for Microsoft in trademark and copyright infringement litigation from the sale of counterfeit software. In published decision, obtained summary judgment, including an award of substantial attorney fees.
Lead Counsel for MGM Grand Detroit in putative class action arising out of enforcement of disassociated persons list at casino. Dismissal of case affirmed by Michigan Supreme Court and Michigan Court of Appeals.
As lead counsel for MGM Grand Detroit and other Detroit casinos in class action alleging violations of the Michigan Consumer Protection Act in operation of slot machines, obtained opinion from Michigan Court of Appeals affirming dismissal of claims.
Lead counsel for Boyd Gaming and successful argued for denial of injunctive relief to stop construction of a multi million dollar expansion of the Blue Chip riverboat casino in Indiana.
Co-lead counsel for Ford Motor Company in three month product liability/wrongful death fuel tank lawsuit resulting in a verdict of no cause of action for Ford.
Lead counsel for Ford Motor Company in product liability lawsuit alleging defective design of the tailgate of an F150 truck which resulted in a verdict of no cause of action for Ford.
Michigan Counsel for the Dalkon Shield Claims Trust to litigate unresolved claims following bankruptcy proceedings.
