Kate Learoyd is a partner in the law firm of McDermott Will and Emery UK LLP, based in its London office. She is a member of the International Disputes group.
Kate specializes in commercial litigation and regulatory enforcement matters. Kate has assisted clients resolve disputes through court proceedings, arbitration and ADR techniques including mediation. She has advised on shareholders disputes, warranty claims, commercial contract disputes and IT claims.
Kate has particular experience of complex claims in the banking and financial services sector. Products and services she has advised on include commodity trading, CDOs (collateral debt obligations), corporate finance, credit cards, derivatives, equity, project finance, securitizations, and structured finance.
Kate regularly advises in relation to cross border disputes. She has experience of complex multi-jurisdictional litigation. She has advised clients on issues relating to transatlantic litigation, such as enforcing judgments, collecting oral and documentary evidence, injunctions, jurisdiction and conflict of laws.
Kate is also experienced in advising individuals and corporations in relation to regulatory enforcement issues. Kate has represented clients in FSA investigations. She has also represented clients in parallel civil proceedings and regulatory investigations. Kate is a member of the Association of Regulatory and Disciplinary Lawyers.
Kate has authored a number of articles on regulatory enforcement topics.
In 1998, Kate was Judicial Assistant at the English Court of Appeal, assigned to the constitution of Lord Justice Kennedy.

Representing an investment bank in complex High Court proceedings arising from a $2bn collateral debt obligation (CDO) transaction
Advising a major international financial services firm in relation to a cross border regulatory investigation
Advising a hedge fund in relation to a FSA investigation of market abuse
Defending a New York subsidiary of an investment bank against a claim in the English High Court. The client successfully brought a jurisdictional challenge which concluded the proceedings Acting for a US company to recover $10m stolen in an international fraud. The client obtained a worldwide freezing injunction and an interim search order
Advising a UK based manufacturing company in relation to the termination of a long term supply agreement. The client obtained a very satisfactory outcome without litigation
Successfully defending a Senior Director subject to a FSA investigation challenge which concluded the proceedings
