Justin C. Eller is an associate in the firm's Baltimore office. He represents clients in a variety of industries, including financial services, warehousing and distribution, multi-housing, consulting, professional services, health care and hospitals, information technology, entertainment and hospitality, and real estate.Mr. Eller advises and defends clients in all areas of employment law, including employment discrimination, sexual harassment, retaliation, wrongful discharge, employment-related torts, wage and hour, employment and severance agreements, non-competition and non-solicitation agreements, unemployment, human resources management, compensation, personnel practices and policies, and employee handbooks.Mr. Eller also assists clients with compliance issues involving the Fair Labor Standards Act (FLSA), the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), and the Office of Federal Contract Compliance Programs (OFCCP). He has extensive experience conducting FLSA compliance audits and sexual harassment investigations, and regularly advises clients on complex issues regarding the interplay among the ADA, the FMLA, and state laws.In addition, Mr. Eller has defended employers throughout the country in matters before the Occupational Safety and Health Administration, including cases involving workplace fatalities, indoor air quality complaints, forklift accidents, anhydrous ammonia releases, ergonomics, emergency response, machine guarding, recordkeeping, and numerous other issues. He also assists employers in developing written safety and health programs, conducting safety and health compliance audits, and interpreting and complying with OSHA regulations. Mr. Eller also has experience litigating disability-related claims outside the employment context. He has defended alarge multi-housing client in a case brought by a tenant under the Fair Housing Act, alleging, among other things, lack of wheelchair accessibility and failure to provide reasonable accommodation. He also has defended public accommodations against claims brought by deaf and hard of hearing individuals under the Rehabilitation Act and Title III of the ADA.
