Joseph H. Paquin, Jr. is a partner in the law firm of McDermott Will & Emery LLP based in the Chicago office. Joe is a member of the Intellectual Property, Media & Technology Department and focuses his practice on patent litigation, counseling and protection.
Joe has significant patent litigation experience for both patentees and accused infringers. Recently, he successfully defended a major Hong Kong textile manufacturer from claims of patent infringement relating to the manufacture of wrinkle-free shirts. In addition to finding the patents-in-suit invalid and not infringed, the Court held the patents unenforceable due to inequitable conduct and awarded attorneys’ fees and costs totaling nearly $6.8 million.
Joe’s practice also entails patent portfolio development and management. He is experienced in the procurement and exploitation of patent rights in a variety of technologies, including consumer electronics products, telecommunication systems, computer displays, printers, disk drives, smoke alarms, food products, dental equipment, injection molding equipment and plastic bottles. He routinely performs patent infringement and validity analyses and counsels clients on avoidance of patent infringement. Joe has extensive experience in patent licensing and has also assisted clients in formulating intellectual property strategies, including the development and implementation of corporate intellectual property programs.
Prior to becoming a lawyer, Joe was employed by RCA Corporation as a member of the patent staff and provided counsel in a variety of technologies, including semiconductors, consumer electronics and telecommunications.
Joe holds a bachelor’s degree in electrical engineering and is a member of the engineering honoraries, Tau Beta Pi and Eta Kappa Nu. He has been recognized as a Leading Lawyer in Intellectual Property Law by the Leading Lawyers Network and is an active member of the American Bar Association, the Chicago Bar Association, the Intellectual Property Law Association of Chicago and the American Intellectual Property Law Association. Joe is admitted to the bars of the state of Illinois, the U.S. District Court for the Northern District of Illinois and the U.S. Court of Appeals for the Federal Circuit and is registered to practice before the U.S. Patent and Trademark Office.
