Mr. Cunningham is Vice President of Operations of The Nielsen-Wurster Group, Inc. with over 30 years of experience in the engineering, construction, development, management, and operation of power and petrochemical plants, refineries and pipelines. As a seasoned engineering executive and skilled negotiator, Mr. Cunningham provides in-depth experience in every phase of large capital projects including development and contract negotiation, construction and project management, and dispute resolution. Mr. Cunningham has a broad understanding of design, engineering and construction practices and procedures. He possesses particular skills dealing with combined cycle power generation, steam turbine generators, electric transmission lines, pipelines, refineries, petrochemical complexes and chemical plants.

Prior to joining Nielsen-Wurster, Mr. Cunningham was employed by the El Paso Corporation where he began his career as process engineer at its west Texas petrochemical complex (ethylene, ammonia, butadiene). At the time, El Paso Corporation was using the petrochemical assignment as a training platform for the support of its Algeria LNG project. Over the years, Mr. Cunningham served in a wide range of capacities. As a commercial developer, he successfully discovered, gained approval of and implemented $800 million in energy capital projects. He was a member of the boards of directors of three major green-field energy projects. As an engineer, he managed the construction of several power generating stations and managed steam turbine generator overhauls/rebuilds. He has managed construction disputes.

Mr. Cunningham is a skilled negotiator, having negotiated many contracts, including EPC construction contracts, liquids and propane sales agreements, operations and maintenance agreements, power sales and transmission agreements, and agreements for services, fuel, financing and management.

In Nielsen-Wurster’s Dispute Resolution Division, Mr. Cunningham acts as an Engagement Manager, leading and executing analyses involving issues of project management and control, scope growth, standards of care, change management, cost impact, schedule delay and disruption, and special topics, including prudence reviews and asbestos litigation. He has testified in regulatory, arbitration and mediation proceedings. Mr. Cunningham has extensive experience with claims management and litigation support, and has participated in claims negotiations in all phases of litigation, including discovery and settlement discussions. He has testified as an independent expert in arbitration and mediation proceedings, in state regulatory and in international arbitration proceedings.

Mr. Cunningham also leads and performs Risk Management and Management Consulting engagements, providing expertise in project, cost and value engineering management, including audits, contract administration and negotiation, feasibility analyses, estimating, bidding and solicitation advice.
