John L. Clancy is a shareholder and member of the environmental and energy law practice group in the Milwaukee office. A 1986 Phi Beta Kappa graduate of the University of Wisconsin, John received his law degree from the University of Virginia in 1990. He served as a law clerk to the Honorable Robert W. Warren, then Chief Judge of the Eastern District of Wisconsin. John provides environmental and energy-related services to a wide variety of entities, including industrial, commercial, municipal, tribal, and trade association clients. With respect to energy-related matters, John's work includes intervention on regulatory rate cases, negotiations of individualized energy tariffs, negotiation of purchase agreements, due diligence for generation projects, certification of green energy credits, negotiation of co-generation facility agreements, representation in land-use disputes regarding the siting of transmission lines and electric substations, and advice regarding tribal energy issues. In the environmental arena, John has represented clients with respect to a wide variety of issues, including brownfield redevelopment, mining and mining waste matters, solid waste landfill sitings, solid and hazardous waste site closure and site remediations, and has provided National Environmental Policy Act, Superfund, RCRA, and Clean Air Act counseling and litigation services. Prior to joining Godfrey & Kahn, John represented industrial clients with respect to several significant environmental insurance coverage matters, and utilizes his experience in these matters to negotiate payroll coverage terms for clients with respect to future environmental liabilities. His work also involves counseling and litigation services with respect to environmental enforcement matters.
Representative Matters
Crandon Mine project. John represented the Forest County Potawatomi Community in the tribe's opposition to the application for mining permits under state and federal laws. The proposal involved one of the most significant zinc and copper underground ore deposits in North American, but it would have been located in culturally-significant pristine and wetland-filled area at the headwaters of the wild and scenic Wolf River. The matter was successfully concluded with the tribe's innovative buy-out of the applicant's interest in surface and mineral rights associated with the project. John has been recognized with Wisconsin's Leaders in Law Award from the Wisconsin Law Journal for his work on this matter.
Wisconsin Initiative Seeking Energy Reform ("WIser"). John worked both to form and represent WIser, an energy user group focused on lobbying for changes in Wisconsin energy law for end users. WIser's members included some of the largest manufacturing and commercial companies with facilities located in the state of Wisconsin.
Wisconsin Industrial Energy Group ("WIEG"). John worked to merge WIser's membership into WIEG, an energy user group focused on involvement in Public Service Commission rate proceedings and energy policy on behalf of end users. He represented WIser and WIEG with respect to Wisconsin Electric Company's Power-The-Future ("PTF") 2,800 megawatt new generation proposal. WIEG, WIser, and other customer groups negotiated substantially improved economic terms and regulatory protections for customers with respect to the construction and operation of the PTF plants. Emerald Park landfill. John represented the City of Muskego on a contested case hearing opposing one of the largest proposed expansions of a municipal solid waste facility in the state of Wisconsin. At the conclusion of the eighteen-day contested case hearing, the matter was resolved by a negotiated agreement, which substantially reduced the size and impacts of the expansion and awarded the City with the largest fee-per-ton payment for municipal waste to date in the state of Wisconsin.
