Ms. Viggiano is an associate in McKee Nelson’s Business Litigation Group. She represents clients in complex commercial disputes, including securities, advertising and other commercial matters. She is experienced in class actions and internal investigations and has handled cases involving breach of contract, business torts and fraud, including federal and state securities fraud, RICO and common law fraud.
Ms. Viggiano's representative matters include:
Securing a judgment in the District Court of California, affirmed by the U.S. Court of Appeals for the Ninth Circuit, dismissing various tort claims brought by a warehouse lender who was attempting to hold Credit Suisse Securities (USA) LLC and DLJ Mortgage Capital responsible for wrongdoing by an unrelated mortgage originator;
Obtaining dismissals of several actions filed against Arab Bank Plc in the Southern District of New York alleging RICO, fraud and a variety of other tort and negligence claims arising out of the 9/11 terrorist attacks;
Representing Credit Suisse Securities (USA) LLC in a breach of contract action involving mortgage-backed securities;
Representing Credit Suisse Securities (USA) LLC in several cases involving securities backed by healthcare receivables which are pending in Arizona, New Jersey, New York and Ohio arising out of the collapse of National Century Financial Enterprises and its affiliates;
Representing ChevronTexaco in a putative class action brought under the Alien Tort Claims Act by Ecuadorian and Peruvian citizens arising from oil exploration activities in the Ecuadorian rainforest;
Representing a special committee of a board of directors for a privately-held corporation in connection with a shareholder derivative action;
Representing Anheuser-Busch Companies, Inc. in commercial free speech matters;
Representing LJM2 Co-Investment L.P. in several matters arising out of the collapse of Enron Corporation;
Submission of amicus briefs concerning advertising issues on behalf of various entities to the Supreme Court of the United States, Sixth Circuit and California State courts; and
Obtaining an order of protection for an indigent victim of domestic violence and favorably settling a child custody dispute for a low-income mother, in partnership with NYC-based inMotion.
Ms. Viggiano served as an articles and notes editor of the St. John's Law Review and authored "People v. Perez: The Second Department Concludes that the Exclusion of Defendant’s Sister from the Courtroom During the Testimony of an Undercover Officer Violated Defendant’s Constitutional Right to a Public Trial," 73:2 St. John’s Law Review 621 (1999).
Each year, Ms. Viggiano co-authors with Steven G. Brody, Summary of Major Commercial Speech Developments, PLI Communications Law Course Book (2002-06) and receives special recognition from Steven G. Brody and Bruce E.H. Johnson, the authors of Advertising and Commercial Speech: A First Amendment Guide (PLI 2002-06). She also co-authored, with Steven G. Brody, California Supreme Court Creates a Major Threat to Newsgathering, Libel Defense Resource Center (May 20, 2001). |
