His trial practice in state and federal courts, as well as before administrative agencies and arbitration panels, includes business and commercial disputes, antitrust law, professional liability, fraud and defalcation claims, shareholder disputes, insurance law, creditors’ rights, real estate, zoning and land use, construction and environmental law. Jim uses his broad and extensive experience to efficiently resolve disputes both large and small and to counsel clients about measures to prevent litigation. His background encompasses the following areas:Real Estate and Construction. Jim represents owners, architects, general contractors, and subcontractors with respect to all kinds of disputes involving construction projects, including construction defect claims and mechanic’s lien claims. He also relies on his experience litigating construction cases to assist clients in drafting construction contracts with an eye toward avoiding disputes. Jim regularly represents parties to real estate disputes involving title claims, boundary disputes, land use and zoning, as well as environmental issues. In addition to being retained directly by individuals, lenders, and developers, he is also often retained by national title insurers and local title companies to represent parties in such cases. Antitrust. Jim has substantial experience representing parties in federal court multi-district litigation involving price fixing, market allocation, and related antitrust law claims. He has successfully represented large corporations who have pursued claims involving hundreds of millions of dollars in such cases, including cases involving vitamins, methionine, linerboard and DRAM (dynamic random-access memory). He has also represented indirect purchasers seeking recovery under state antitrust laws. Jim works closely with expert economists who develop economic models underlying antitrust damage claims. He has conducted extensive discovery, both domestically and abroad, to gather antitrust conspiracy and damage evidence.
