Ira A. Rosenau represents regional and national businesses in a full range of commercial litigation matters, including real estate disputes, partnership disputes, negotiable instrument litigation, tax litigation, construction litigation, patent litigation, landlord/tenant disputes and general business torts and breach of contract cases. He has successfully litigated cases in both federal and state courts throughout the Philadelphia area and elsewhere.
Mr. Rosenau has:
in a case of first impression under certain FCC cable regulations, obtained a trial decision in favor of a NYSE cable company;
obtained injunctive relief against videotape and dvd piracy under the federal copyright and trademark statutes;
obtained partial summary judgment on behalf of a national bank against a NYSE brokerage company, leading to a favorable settlement and recovery;
successfully settled complex securities and motion pictures licensing case on the eve of trial;
represented AMEX company in multi-million dollar litigation over major theme-park attraction construction and design;
obtained injunction against former employee of client on an "inevitable disclosure of trade secrets" theory;
successfully vacated a nine-year old default judgment in federal court on behalf of a music industry personality;
settled favorably an age discrimination suit during jury selection phase of trial;
settled national consumer class action concerning gift cards on behalf of NASDAQ client;
on third day of trial, obtained favorable settlement of a personal injury case for client;
successfully settled complex real estate dispute for regional bank against national REIT and supermarket chain;
as second chair, successfully tried a complex contract dispute involving deconstruction of a tax shelter scheme, resulting in an award in excess of $2 million to a large regional bank;
obtained a defense decision in a case involving local tax authorities' attempts to impose realty transfer taxes on an international bank in a deed-in-lieu of foreclosure transaction;
during trial, assisted in obtaining settlement of a complex construction dispute on behalf of a major university;
during trial, obtained settlement of a quiet title/foreclosure case for a national bank against a national title insurance company;
successfully defended and settled a multi-million dollar patent infringement action on behalf of a NYSE company involving sunglass lens technology;
successfully tried a commercial eviction case in connection with a large Philadelphia apartment complex;
successfully prosecuted and settled a construction and fraud case on behalf of a regional bank;
represented a large charitable foundation in a multimillion dollar contract dispute. |
