Mr. Selden’s practice focuses primarily on complex civil litigation, specializing in the defense of financial institutions in state and federal court, arbitration and regulatory proceedings. He has defended brokerage firms throughout the country against claims asserted in arbitration by customers or by former employees. Mr. Selden has also defended a significant number of companies and individuals in securities class action litigation, including the representation of a major brokerage firm in a federal securities class action which was tried to a successful conclusion in the Middle District of Tennessee. Tried or supervised the trial of over 100 sales practice cases in arbitrations before the NASD or NYSE. Co-lead counsel in the 6 week trial of a securities class action which had been certified against a brokerage firm, resulting in the dismissal of all claims. McInnis v. Merrill Lynch, Pierce, Fenner & Smith Inc., 821 F. Supp. 1243 (M.D. Tenn. 1992). Successful in having class action against a brokerage firm, alleging improper sales of Class B mutual funds, removed and dismissed under SLUSA. Behlen v. Merrill Lynch, Pierce, Fenner & Smith Inc., 311 F. 3d 1087 (11th Cir. 2002). Represented brokerage firm on appeal in decision reversing trial court order certifying a class of bank customers who were allegedly deceived into purchasing uninsured securities.
