Hugh Howser concentrates his area of practice in civil litigation. Mr. Howser successfully defended a national drug distribution company in the first reported prosecution by the FDA of alleged violations of the Prescription Drug Marketing Act (21 USC § 353). He successfully represented a national steel fabricator in the Tennessee River bridge collapse litigation, Trinity Industries, Inc. v. McKinnon Bridge Company, Inc. 77 SW3d 159 (Tenn. Ct. App. 2001). He has represented regional clients in various employment related cases, including discrimination, sexual harassment, FLSA, and ERISA matters. He was lead counsel in defense of wage & hour cases in United States District Court, Northern District of Alabama, in which class certification was denied. Mertz v. Treetop Enterprises, Waffle House, Inc. He was lead counsel in the successful prosecution of an ERISA early retirees benefit case involving 23 former management/executives of Pirelli Tire. James v. Pirelli, 305 F.3d 439 (6th Cir. 2002). Mr. Howser also represents national and regional general contractors, subcontractors, and real estate development and management companies in litigation, land use planning and zoning regulatory matters.
