Herve Aitken focuses his practice on the representation of U.S. and foreign corporations in litigation in federal courts and in collective bargaining negotiations with labor unions. He has practiced labor and employment law for more than 30 years. Herve's specialty focus is representing employers in the Multi-employer Pension Plan Amendments Act of 1980 (MPPAA) in four primary areas: transactional work limiting a controlled group's exposure to withdrawal liability; MPPAA arbitration; MPPAA litigation; and MPPAA federal legislation.
Earlier in his career Herve served for eleven years, most recently as Director of the Industrial Relations Department, at the American Trucking Association. His tenure there included work on MPPAA. He also worked at the National Railway Labor Conference and at Consolidated Freightways Corporation of Delaware, where he managed all of the company's employment law litigation, arbitration and related matters.
He is admitted to practice in the U.S. Supreme Court, the Seventh and Eighth Circuits, several federal district courts and before all courts in the District of Columbia.
Herve is President of the Multi-Employer Pension Plan Alliance, which represents companies to achieve employer relief under current legislative attempts to amend MPPAA by organized labor. He has been on the Board of the North American Transportation Employer Relations Association since 1987. Herve served as the first President of the Old Town Village Civic Association in 1999 and was reelected to the Board of Directors from 2001-2003. He was also named by the Mayor of the City of Alexandria to serve on the Woodrow Wilson Bridge Neighborhood Task Force from 2001-2003. Herve is AV® Peer Review Rated by Martindale-Hubbell and has been named a Life Member in the National Registry of Who's Who. He is also listed in The Best Lawyers of America.
