Harvey Weissbard joined FKSA after a distinguished career on the Superior Court of New Jersey, initially as a trial judge in the Criminal Division, and for eight years as a member of the Appellate Division, retiring in 2008 as acting Presiding Judge of Part F. Judge Weissbard authored numerous significant published decisions in virtually every area of law, including torts, employment, land use, privacy, and criminal. He was appointed by the Chief Justice of the New Jersey Supreme Court as Chairman of the Supreme Court's Committee on the Rules of Evidence. He was also designated to serve as Vice Chairman of the Committee on Recordation of Custodial Interrogations, which led to a landmark report, subsequently adopted by the Supreme Court, requiring recordation of law enforcement questioning of criminal suspects.
Mr. Weissbard graduated from Cornell University, where he majored in physics, and from Harvard Law School. Following graduation from law school he served two years on active duty as an officer in the U.S. Army. Prior to his judicial appointment, Mr. Weissbard, who is admitted in both New Jersey and New York, engaged in an active and varied trial and appellate practice for thirty-three years. He has tried numerous state and federal cases, both civil and criminal, and argued many appeals in state and federal courts.
Active in bar activities, Mr. Weissbard was a trustee of the New Jersey State Bar Association, representing Essex County, and is a past President of the New Jersey Association of Criminal Defense Lawyers. He is a Fellow of the American College of Trial Lawyers and a member of the American Board of Trial Advocates.
Mr. Weissbard engages in mediation and arbitration of complex disputes, federal trial and appellate litigation, and consultation on state trial and appellate matters.
