Litigation and Financial Consulting
Directed an internal investigation for a leading investment bank related to a debt buyback mandate it had conducted for an emerging market country in advance of the country's debt restructuring under the Brady Plan. Our work involved interviewing key bankers and operational staff involved in the debt buyback mandate, quantifying the purchase price, principal amount, and past due interest associated with the debt repurchased, and analyzing contemporaneous financial and accounting records to reconstruct the flow of funds between the emerging market country, investment bank, and Brady Plan closing agent. The findings of our internal investigation were documented in a formal report and presented to certain governmental agencies of the emerging market country.
Managed an engagement involving a $1.5 B dispute between a telecommunications reseller and a Fortune 500 hospitality company over the value of telecommunications and enhanced services (e.g., high speed internet access and video-on-demand) to be provided by the reseller to the locations owned and managed by the hospitality company based on an alleged exclusive worldwide telecommunications and enhanced services contract serviced through a joint-venture between the parties. Analyses performed included a benchmarking analysis of the services to be provided against telecommunications, hospitality and enhanced services industry standards, cost of capital research and estimation, sensitivity and scenario analysis on key financial model assumptions and the rebuttal of an opposing expert's valuation and damages analysis.
Conducted a royalty audit and investigation for a Fortune 500 software provider involving a dispute over royalty payments associated with a complex software licensing agreement with another Fortune 500 software provider. Responsibilities included managing a team of consultants in analyzing a transactional database containing over 2 million electronic records representing approximately $5 B in software sales, recalculating royalty payments based on a complex contractual formula triggered by the sale of a security software code, conducting interviews of company personnel, and performing other analyses supporting alternative royalty calculation methodologies.
Insurance Claims Consulting
Managed the preparation and submission of a property damage and business interruption insurance claim arising from the September 11, 2001 terrorist attacks on the World Trade Center. Supervised the creation of a financial model to quantify the net profits and fixed costs of the client's hotels affected by the attacks. Engagement included analyzing each hotel's historical operating statements, hospitality market research, and management's budgets and forecasts. The client was successful in reaching a $372 M settlement with its insurers.
