Frank Top is a partner in the firm's Special Litigation, Bankruptcy and Workout group. He has been practicing law since 1988 when he joined Chapman and Cutler LLP. Mr. Top has experience working with clients in loan workout situations, both inside and outside a bankruptcy proceeding. He has participated in a variety of different insolvency proceedings, including traditional Chapter 11 bankruptcy proceedings, insurance rehabilitation and liquidation proceedings, and bank liquidation proceedings. In addition to his work in insolvency proceedings, Mr. Top has participated in related civil litigation matters such as foreclosure proceedings, proceedings brought against officers and directors and other related actions. Mr. Top has devoted a significant amount of time recently in the following proceedings:Representation of an indenture trustee for 11 series of bonds issued by health facilities development corporations for the renovation and operation of ten Alzheimer's care facilities throughout the United States Representation of bondholders in the bankruptcy and ultimate sale of a large steel manufacturer Representation of the creditors' committee in the bankruptcy of a producer of magnesium in the United States Representation of a secured creditor in an insurance rehabilitation and liquidation proceeding including a defense of a preference and fraudulent conveyance action Representation of the creditors' committee in the bankruptcy of a major airline Representation of an indenture trustee in an action brought on behalf of noteholders against the officers and directors of a corporation for a fraudulent conveyance, payment of an improper dividend and breach of fiduciary duties. |
